Application and acceptance of terms 

These website terms of use (these ‘terms) contain legal obligations. Please read these terms before using the website and any Habit & Kin product or service.

Habit & Kin (‘we’ or ‘us’) uses the Website to provide you with information about our brand and products and services and to deliver an online store (the ‘store’) for the purchase and sale of our products and services. The store, together with any information, customer service or any related services provided to you through the website, are referred to in these Terms as the ‘Habit & Kin Products and Services’.

For the purposes of these terms, ‘Website’ means, collectively, www.habitandkin.com and all related webpages and websites (including without limitation any unique URL links provided by Habit & Kin to its customers and any optimized website), but does not include any third-party websites which are linked or may link from the website whether or not such third party websites are used in association with the Habit & Kin products and services.

Access to and use of the information provided through the website and Habit & Kin products and services (collectively referred to as the ‘content’), is subject to your acceptance of and compliance with these terms. By using the website you agree to be bound by and indicate and acknowledge your acceptance of these terms and conditions.

By accessing or using the website and/or Habit & Kin products and services or otherwise accepting or agreeing to these terms, you consent to the collection, use, disclosure and retention of your personal information by Habit & Kinas set out in the privacy policy, which may be amended from time to time and which is incorporated into these terms. The privacy policy sets out the types of personal information that we collect through your use of the website and/or the Habit & Kin products and services, and the purpose for such collection, use and disclosure.


Changes to terms; No waiver

We reserve the right to add to, delete or otherwise change these terms at any time. Your use of the website after any amendments or updates of these terms shall signify your acceptance of such revised terms. The most current version of these terms will govern your use of the website. We will post any changes to these terms on the website and update the revision date at the beginning of these terms to see recent changes. Any changes of these terms or waiver of our rights hereunder shall not be valid or effective except in written agreement bearing the physical signature of one of our directors or officers. No purported waiver or modification of these terms by us via telephone or email communication shall be valid.


General rules of user conduct 

In using the website and the content you, agree not to do any of the following:

Conduct or promote any illegal activities;

Interfere with or disrupt the website or servers or networks connected to the website, or disobey any requirements, procedures, policies or regulations of networks connected to the website.

Intentionally or unintentionally violate any applicable local, state provincial, federal or international law or regulation;

Attempt to reverse engineer or jeopardize the correct functioning of the website, or otherwise attempt to derive the source code of the software (including the tools, methods, processes, and infrastructure) that enables or underlies the website;

Attempt to gain access to secured portions of the website to which you do not possess access rights;

Use the website to generate unsolicited email advertisements or spam


Your account

In order to make purchases in the store, you may need to create an account with us. If you sign up, you are responsible for maintaining the confidentiality of login information and for restricting access to your computer or account.  You agree to notify us immediately of any unauthorized use of your password or account and agree to accept responsibility and indemnify us and our subsidiaries, affiliates, directors, officers, agents and employees, for all activities that occur under your account or password.

 

Security 

While we make commercially reasonable efforts to keep the website secure and protected the data you transmit to us through the website, information sent or received over the internet us generally un-secure and we cannot and do not make any representation or warranty concerning security of any communication to or from the website or any representation or warranty regarding the interception by third parties of personal or other information and as such cannot guarantee the security of the website or such information and will not be liable for any unauthorized access to or use of the data transmitted via the website.


Safety of employees

All Habit & Kin employees are covered by workers’ compensation insurance in accordance with applicable laws. To protect the health and safety of our employees:

  1. They will not move anything heavier than 35lbs should you require us to clean behind something heavier, please move the item prior to our arrival to allow access to the area. 
  2. They will not climb higher than a two step stool, climb any ladders or stand on any unstable surfaces.

Materials that present hazards to the health or safety of our team will be left untouched. Such hazardous materials include but are not limited to: items or areas containing bodily fluids, excretions, needles and band substances. Our team is advised to clean around the areas that contain such hazardous materials and in cases of excessive contamination, our team will vacate the area. If our team feels that their personal safety is in danger (someone in the home is intoxicated, vicious animal not contained, exposure to drugs or firearms, etc.), the team will leave the site of the services (the ‘premises’) and you are still responsible for the full cost of the scheduled service.  We will attempt to reach you by phone if this situation should arise.


Equipment and Supplies 

Habit & Kin provides all required equipment, supplies, cleaning products, tools and other items necessary to perform our services.  Our team will not use any equipment, supplies, cleaning products or other items in your home unless specified by you at the initial consultation. 


Fees

The fees quoted in confirmation are estimates only and may be subject to change in accordance with these terms based on the actual condition of the premises.  Habit & Kin may change its fees from time to time and will provide you with notice should this arise. Fees are exclusive of all applicable taxes.


Payments 

We accept the following forms of payment:

Mastercard, VISA, AMEX, cheque, cash, etransfer.

Payment must be made in full to Habit & Kin upon competition of service. A finance charge of 2% per month (24% annually) will be charged on all past due balances. A $25.00 fee is applied to NSF or declined cheques.


Cancellations 

Up until 2 business days (48 hours ) before your service you may request a reschedule or cancel your appointment.

Within two business days (48 hours) you will be charged 100% of your scheduled service.

If you notify Habit & Kin upon arrival that we can not enter the premises you will be charged 100% of the scheduled service.


Lock Out 

If we are unable to gain entry to the premises during scheduled service a member of our team will contact you via phone call to request further instructions. Our team members will wait 15-20 minutes before proceeding to their next scheduled appointment. If the team member can not gain access to the premises after the allotted 20 minute window you will be charged for 100% of the scheduled service. 


Access

You have a couple of options for providing habit & Kin access to the premises. We strongly recommend that a key or a door code be provided to Habit & Kin, because your scheduled services may vary. Your key will be kept in a safe and secure key safe. All keys are coded and for security will never have your name, or address attached to them.

For your safety, we do not return keys by mail.  We will deliver them to your home if and when you should request it returned. An appointment will be scheduled and your key will be returned. 

If you are unable to give Habit & Kin a door code or key you will need to meet our team for each appointment to allow us entry.


One - Hour Arrival Window

We provide you with a one hour arrival window relative to your scheduled appointment to allow for factors beyond our control such as traffic conditions, weather, etc.  

Leaving a key with Habit & Kin or providing door codes is definitely the easiest way to give us access to the premises and relieves you from the necessity to be at the premises to let our team members in.


Pets Escaping from the Premises 

We cannot be responsible for pets that ‘escape’ when our team enters/exits the premises. If your pet will be ‘roaming free’ during the cleaning, please let us know in advance so we can be on alert when we open doors and windows. 

Our team members are great with animals and do their absolute best to ensure your pets are safe and secure during their scheduled service. 


Clutter

The cleaning will be more satisfactory if our team does not have a great deal of clutter with which to contend.  If the Premises are heavily cluttered this may affect the estimated time quoted and may result in a request for additional time for the scheduled appointment.

Damage/Loss to property 

Habit & Kin is bonded and insured. You must notify us of any damage within a 48 hour window after completion of service. 

Key replacement / locksmith fees are paid by Habit & Kin only if keys are lost or miscoded by Habit & Kin and its team.

Habit & Kin will not be liable to you for:

Loss or damage to any items that are not secured in a proper manor ( such as heavy pictures hanging from thumb tacks, not anchored properly to walls etc)

Any pre-existing damage such as scratches or dings in windows, paint, walls, furniture, floors, etc.

Damage due to faulty and/or improper installation of any item.

Failure of any surface (marble, granite, etc.) to be properly sealed and ready to clean without causing damage.

All fragile and highly breakable items must be secured or removed by you prior to the cleaning appointment.  If you have items you prefer we do not clean or handle, please let us know at time of initial meeting.


Wear and Tear 

Over the years wear and tear can accumulate. Baseboards, bottom of showers and tubs, mold/mildew, excessive water spots and soap scum on glass shower doors, worn flooring grout lines, window tracks, etc. are all areas where wear and tear will have an outcome on the final look of the cleaning. These areas may take more than one service to improve and in some cases it will not be possible to improve by cleaning. Habit & Kin will take notes and include this in your emailed checklist at the end of their scheduled service.

Return Policy

All payments are non-­refundable within 48 hours of service scheduled.

If you need to reschedule your appointment, please provide us with at least 48 hours notice and we’ll set you up at the next best available date that works for our mutual schedules.

If you need to cancel, please let us know at least 48 hours prior to your appointment to reschedule or secure a refund.
